Shifting Amendments<\/u> <span  style=\"color: #E26F22;\"><u>\u79fb\u4f4d\u4fee\u6539<\/span><\/u><\/b><\/font><br \/>\nIf the application was filed after March 31, 2007, claims amended in response to an office action (OA) must satisfy \u201cUnity of the Invention\u201d with the examined claims. Otherwise, new claims are rejected before the final OA and not entered after the final OA.<br \/>\n<span  style=\"color: #E26F22;\">\u5982\u679c\u7533\u8bf7\u662f\u57282007\u5e743\u670831\u65e5\u4e4b\u540e\u63d0\u51fa\u7684\uff0c\u5219\u5fc5\u987b\u6ee1\u8db3\u9488\u5bf9OA\u4fee\u6539\u540e\u7684\u6743\u5229\u8981\u6c42\u4e0e\u88ab\u5ba1\u67e5\u7684\u6743\u5229\u8981\u6c42\u5177\u6709\u201c\u53d1\u660e\u5355\u4e00\u6027\u201d\u3002\u5426\u5219\u65b0\u6743\u5229\u8981\u6c42\u5c06\u5728\u6700\u7ec8OA\u4e4b\u524d\u88ab\u62d2\u7edd\uff0c\u4e14\u6700\u7ec8OA\u4e4b\u540e\u4e0d\u4f1a\u88ab\u8003\u8651\u3002<\/span><br \/>\n<br \/>\n<font size=\"3.5\"><b><u>2. Unity of the Invention Requirements<\/u> <span  style=\"color: #E26F22;\"><u>\u53d1\u660e\u5355\u4e00\u6027\u7684\u8981\u6c42<\/span><\/u><\/b><\/font><br \/>\nClaimed inventions must satisfy one of the following.<br \/>\n<span  style=\"color: #E26F22;\">\u6743\u5229\u8981\u6c42\u4e2d\u9650\u5b9a\u7684\u53d1\u660e\u8981\u6ee1\u8db3\u5982\u4e0b\u4e4b\u4e00<\/span><br \/>\n(1)The invention contains all elements of the examined claim 1 and the objects or features of the invention are relevant to those of the examined claim 1.<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u8be5\u53d1\u660e\u5305\u542b\u88ab\u5ba1\u67e5\u7684\u6743\u5229\u8981\u6c421\u7684\u5168\u90e8\u8981\u7d20\uff0c\u4e14\u53d1\u660e\u7684\u76ee\u7684\u548c\u7279\u5f81\u8981\u4e0e\u88ab\u5ba1\u67e5\u7684\u6743\u5229\u8981\u6c421\u76f8\u5173\uff09<\/span><br \/>\n(2)The invention contains a special technical feature (STF), which is searched only in the first dependent chain of claims in the examination.<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u8be5\u53d1\u660e\u5305\u542b\u7279\u5b9a\u6280\u672f\u7279\u5f81\uff08STF\uff09\uff0c\u53ea\u6709\u5728\u7b2c\u4e00\u4ece\u5c5e\u6743\u5229\u8981\u6c42\u94fe\u4e2d\u624d\u4f1a\u5728\u5ba1\u67e5\u4e2d\u88ab\u68c0\u7d22<\/span><br \/>\n(3)The claim can be examined without any additional search. (Practically, discretional)<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u53ea\u6709\u5f53\u65e0\u9700\u989d\u5916\u68c0\u7d22\u65f6\uff0c\u6743\u5229\u8981\u6c42\u624d\u80fd\u88ab\u5ba1\u67e5<\/span><br \/>\n<br \/>\n<font size=\"3.5\"><b><u>3. Our Suggestions<\/u> <span  style=\"color: #E26F22;\"><u>\u6211\u4eec\u7684\u5efa\u8bae<\/span><\/u><\/b><\/font><br \/>\n<b>(1) When filing a patent application in Japan <span  style=\"color: #E26F22;\">\u5f53\u5728\u65e5\u672c\u9012\u4ea4\u4e13\u5229\u7533\u8bf7\u65f6<\/span><\/b><br \/>\na. List the most important independent claim first, for the above 2(1) reason.<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u9996\u5148\u5217\u51fa\u6700\u91cd\u8981\u7684\u72ec\u7acb\u6743\u5229\u8981\u6c42\uff0c\u56e0\u4e3a\u4e0a\u8ff0\u539f\u56e02(1)\u3002<\/span><br \/>\nb. Make dependent claims directly or indirectly depend form claim 1 as well, for the above 2(1) reason.<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u8ba9\u4ece\u5c5e\u6743\u5229\u8981\u6c42\u4e5f\u90fd\u76f4\u63a5\u6216\u95f4\u63a5\u5f15\u7528\u6743\u5229\u8981\u6c421\uff0c\u56e0\u4e3a\u4e0a\u8ff0\u539f\u56e02(1)\u3002<\/span><br \/>\nc. List more important dependent claims first for the above 2(2) reason.<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u5217\u51fa\u66f4\u91cd\u8981\u7684\u4ece\u5c5e\u6743\u5229\u8981\u6c42\uff0c\u56e0\u4e3a\u4e0a\u8ff0\u539f\u56e02(2)\u3002<\/span><br \/>\nd. Make dependent claims depend from as many claims as possible, for the 2(2) reason.<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u8ba9\u4ece\u5c5e\u6743\u5229\u8981\u6c42\u5f15\u7528\u5c3d\u53ef\u80fd\u591a\u7684\u6743\u5229\u8981\u6c42\uff0c\u56e0\u4e3a\u4e0a\u8ff0\u539f\u56e02(2)\u3002<\/span><br \/>\n<br \/>\n<b>(2) When responding to an OA in a <u>foreign country<\/u> <span  style=\"color: #E26F22;\">\u5f53\u7b54\u590d<u>\u5916\u56fd<\/u>OA\u65f6<\/span><\/b><br \/>\nIf the first independent claim is deleted or limited by incorporating a claim that is outside the first dependent chain of claims, change the order of the claims in Japan, because the same amendment might be denied after the examination. (Above 2(1),2(2))<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u5982\u679c\u7b2c\u4e00\u72ec\u7acb\u6743\u5229\u8981\u6c42\u88ab\u5220\u9664\u6216\u8005\u901a\u8fc7\u5408\u5e76\u7b2c\u4e00\u4ece\u5c5e\u6743\u5229\u8981\u6c42\u94fe\u4ee5\u5916\u7684\u6743\u5229\u8981\u6c42\u88ab\u9650\u5b9a\uff0c\u5219\u6539\u53d8\u65e5\u672c\u6743\u5229\u8981\u6c42\u7684\u987a\u5e8f\u3002<\/span><br \/>\n<br \/>\n<b>(3) When responding to an OA in Japan<\/u> <span  style=\"color: #E26F22;\">\u5f53\u5728\u65e5\u672c\u7b54\u590dOA\u65f6<\/span><\/b><br \/>\na. Try to incorporate all features of original claim 1 into the amended claims.<br \/>\n\u3000<span  style=\"color: #E26F22;\">\u5c3d\u91cf\u5c06\u539f\u6743\u5229\u8981\u6c421\u7684\u5168\u90e8\u7279\u5f81\u90fd\u5408\u5e76\u5230\u4fee\u6539\u540e\u7684\u6743\u5229\u8981\u6c42\u4e2d\u3002<\/span><br \/>\nb.
