Associated designs can be filed within 10 years and last 25 years from the filing date of the first base design. \r\n<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System1-e1637826504216.jpg\" alt=\"\" width=\"320\" height=\"244\" class=\"alignright size-full wp-image-24544\" \/><\/p>\r\n<br \/>\r\n<p class=\"mb-5\">\r\n\t<b>\u25c7Exceptions to Novelty Loss<\/b><br>\r\n\tIf design A is filed, publication or public sale of the similar design X does not affect the registrability of associated design B being later filed (<b>\u201cEXCEPTION\u201d<\/b> to novelty loss).\r\n<br \/><\/p>\r\n<\/br>\r\n<h3><span class=\"blue\"><font size=\"4\"><b><u>Problem 1: <i>\u201cDomino of Rejection\u201d<\/i><\/u><\/b><\/font><\/span><\/h3>\r\n<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System2.jpg\" alt=\"\" width=\"420\" height=\"298\" class=\"alignright size-full wp-image-24553\" srcset=\"https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System2.jpg 420w, https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System2-300x213.jpg 300w, https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System2-150x106.jpg 150w\" sizes=\"auto, (max-width: 420px) 100vw, 420px\" \/>\r\n<p class=\"mb-5\">\r\n\t<i><b>Case<\/b>: Associated designs are filed sequentially, starting with A as the base, then B, C and D. Right after filing each, the applicant sold products that represent the filed design.<\/i><\/p>\r\n\r\n<p class=\"mb-5\">\r\n\t\u261e If publicly sold design X is considered dissimilar to design A, the EXCEPTION does not apply, and B is rejected because of X, C is also rejected by the sales of B because C cannot be associated with rejected B, and <b>EXCEPTION<\/b> does not apply. Then, D is rejected by the sales of C because D cannot be associated with the rejected C, and <b>EXCEPTION<\/b> does not apply (<b><i>Domino of Rejection<\/i><\/b>).<\/p>\r\n<\/br>\r\n<h3><span class=\"blue\"><font size=\"4\"><b><u>Problem 2: A design similar to multiple unassociated designs that are publicly known cannot be registered<\/u><\/b><\/font><\/span><\/h3>\r\n<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System3.jpg\" alt=\"\" width=\"228\" height=\"186\" class=\"alignright size-full wp-image-24555\" srcset=\"https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System3.jpg 228w, https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System3-150x122.jpg 150w\" sizes=\"auto, (max-width: 228px) 100vw, 228px\" \/>\r\n<p class=\"mb-5\">\r\n\t<i><b>Case<\/b>: After unassociated designs A and B are registered and published, you would like to file a design X similar to both A and B.<\/i><\/p>\r\n\r\n<p class=\"mb-5\">\r\n\t\u261e <u>A design can be associated with only one design.<\/u> In addition, <b>EXCEPTION<\/b> only applies to the associated design group or their similar designs. Here, X is rejected even if X is associated with A because <b>EXCEPTION<\/b> does not apply to the published B not associated with A.<\/p>\r\n<\/br>\r\n<h3><span class=\"blue\"><font size=\"4\"><b><u>RYUKA\u2019s Suggestions<\/u><\/b><\/font><\/span><\/h3>\r\n<p class=\"mb-5\"><b>1. Filing associated designs quickly without relying on the 10-years<\/b><br>\r\nThis avoids rejection based on other known designs and the Domino of Rejection. We recommend filing associated designs together with the base design, if possible.<\/p>\r\n\r\n<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System4.jpg\" alt=\"\" width=\"273\" height=\"316\" class=\"alignright size-full wp-image-24557\" srcset=\"https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System4.jpg 273w, https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System4-259x300.jpg 259w, https:\/\/www.ryuka.com\/en\/wp\/wp-content\/uploads\/Related-Design-System4-130x150.jpg 130w\" sizes=\"auto, (max-width: 273px) 100vw, 273px\" \/>\r\n<p class=\"mb-5\"><b>2. Filing an intermediate design C when filing dissimilar designs A and B to associate all designs<\/b><br>\r\nIf A and B are in an associated group thanks to C, X can be registered because <b>EXCEPTION<\/b> applies to both A and B. However, you cannot register C anymore once you file A and B.\r\n<\/p>\r\n<p class=\"mb-5\"><b>3. Filing an intermediate design C if the JPO may deny the association of designs A and B.
