This workshop will provide hands-on instruction for assertion defense. You will learn how to research and quantify the risk posed by a patent infringement warning letter sent to your company using a sequence of steps and research tools. The workshop will teach attendees the following:<\/p>\n

I. Researching the entity that sent you the warning letter:<\/h5>\n

\ta. Has the entity that sent you the warning letter filed patent infringement lawsuits, and if yes, where and how many;
\n\tb. Have any invalidity proceedings (such as inter partes reviews in the USPTO) or declaratory judgment actions (in District Court) been filed against the entity;
\n<\/p>\n

II. Researching the patents listed in the warning letter;<\/h5>\n

\ta. Have the maintenance fees been paid for the patents listed in the warning letter?
\n\tb. Where did the patents listed in the warning letter come from;
\n\tc. Does the entity that sent the warning letter really own the patents in the warning letter \u2013 how to check the chain of title;
\n\td. Identifying the most common title defects;
\n\te. Does the warning letter put your company on notice for patent infringement such that damages begin to accrue;<\/p>\n

III. Internal Research at your company<\/h5>\n

\ta. Did any of the entities that owned the patents give your company a license;
\n\tb. Identifying the components involved and determining whether your company is entitled to indemnification;
\n\tc. Types of indemnification and how to give proper written notice of indemnification to your company\u2019s suppliers; <\/p>\n

IV. Drafting an appropriate response to the warning letter:<\/h5>\n

\n\tb. After assessing the risk, what is the most appropriate response to the warning letter;
