Discovery in America is broad, expensive and can be dangerous for Japanese companies who are not familiar with the rules and procedures. The Seminar will provide valuable information about the rules and procedures for American discovery along with effective strategies to avoid creating “bad documents” (e.g., documents created during a patent clearance, licensing demand or patent assertion defense), and understanding when the attorney-client privilege and work product doctrine can and cannot protect your company’s documents from discovery.

Eric Kirsch was a partner and patent litigator in a New York law firm before joining Nikon as Chief Intellectual Property Counsel, a position he held for 11 years. Mr. Kirsch recently returned to private practice as the Managing Partner of Davidson Berquist’s Tokyo Office. Mr. Kirsch has a Bachelor of Science Degree in Electrical Engineering from Johns Hopkins University and Juris Doctorate Degree from the University of Pittsburgh, where he graduated cum laude and was Notes and Comments Editor of the University of Pittsburgh Law Review.
